This contract is entered into between Peak Group Pty (Ltd) 2018/440921/07, herein also referred to as "Peak-online” and yourselves as the above listed parents. By signing this contract, you acknowledge that your child’s attendance on Peak- online’s platform is voluntary, out of your own choice and is not a right.

You acknowledge that Peak-Online is a private institution providing a private tuition service to Private Candidates as part of their preparation to write their Cambridge Assessment International Education (CAIE)exams. Peak is regarded as a business entity and is not registered with the WCED or Cambridge International. You acknowledge that should your child be under the age of 15 years you as the Parent / Guardian acknowledge responsibility for the registration or choice not to register your child with the WCED. You acknowledge that your child’s attendance on Peak-Online platform is by no means a guarantee or implied to be a guarantee that your child will be successful in passing any CAIE Examination/s.

POLICIES

If at any time your child's conduct, academic progress, or co-operation with tutors or management of Peak-Online is not in keeping with the standards set out in the Peak-Online student guide*, or any other requirement or stipulation that might be issued from time to time by the staff of Peak-Online of whatever nature, Peak-Online reserves the right to: 1) Terminate the enrolment contract, 2) Refuse entry of the student onto any and all platforms of Peak-Online, 3) Claim damages from the Payee and Parent jointly and severally liable for the account 4) Take whatever action deemed necessary to recover outstanding fees or any related costs.

PARENT'S/GUARDIAN GENERAL OBLIGATIONS

You as the above-listed parents/guardians acknowledge to support Peak-Online procedures and policies as listed in our Peak-Online Student guide and understand that these will be revised from time to time of which you will be notified accordingly as might be reasonably practical.

You as the above listed parents acknowledge to support Peak -Online by communicating with Peak-Online’s Management team regarding anything of concern. You agree that should there be any matter of concern, that you will, as first recourse, address these matter or matters directly with the Management of Peak-Online and not use any social media platforms or other public platform or parent to express your grievances or concern in such a way that will harm Peak-Online publicly in anyway. Peak-Online reserves the right that should this happen, to take whatever measure, that might include legal action, to protect Peak-Online’s public interests of whatever nature.

INDEMNITY

You acknowledge that should your child physically enter Peak Academy’s premises, Peak Academy does not take any responsibility for any theft, loss, damage or destruction to any property of whatever nature brought onto the premises of Peak Academy by your Child. You consent to your Child participating in the activities of Peak Academy, both inside and outside of the premises of Peak Academy which may entail risk or physical injury, or even death. This includes your child travelling to and from and participating in activities and programmes outside Peak Academy premises. Subject to Peak Academy taking reasonable care to avoid harm and safety for any gross negligence on the part of Peak Academy, its employees or agents, Peak Academy will not be held responsible for any loss, damage and death, resulting from such activities or programmes and you indemnify Peak Academy and any of its employees against any claims in that regard of whatever nature. That you give permission to any of Peak Academy’s employees or representatives to attend to any injury the student suffers while taking part in any activity, and to consent to any medical treatment with the same authority as a parent (in loco parentis) where they cannot contact the student’s parent or guardian in a medical emergency. You as the parent agree to pay any medical or related costs incurred by the institute for treating student.

MEDIA RELEASE

During the year your child may be photographed or videoed during Peak events and day-to-day activities. With your consent, the photograph or video may be reproduced and released for the use in the media i.e.: newspapers, brochures, television, videos, the internet, and our website and social media platforms. By your signature on this enrolment form we accept this as your consent. If you DO NOT give consent for your child's photograph or video to be reproduced and released for use in the media, please request from our info desk the MEDIA RELEASE OPT-OUT FORM to be completed and submitted as an addendum to your enrolment documentation.

Payee Responsible for the Account


*Please submit a copy of your ID document as part of enrolment documentation.

Financial Terms and Conditions


1. PARENT RESPONSIBILITY

You as the Parents acknowledge full responsibility, for the payment of any Fees applicable to your Child attending Peak-Online. You also acknowledge that Online Fees are payable in advance in accordance with the provisions of the schedule of fees in respect of the applicable period.

2. THIRD PARTY

In the event of a Third Party taking responsibility for the payment of the Fees, you by your signature to the Contract with Peak-Online, bind yourself jointly and severally in your personal capacity as surety and co-principal debtor with the Third Party for payment to Peak-Online of any amounts which are owing and may at any time become owing to Peak-Online by the Third Party. The liability of the Third Party (if any) and of each Parent arising out of this contract shall be joint and several. The Payee and Parents jointly and severally accepts liability for the entire account of the student which will include all fees owed to Peak-Online including, but not limited to, monthly fees and any extra ad hoc fees, penalty fees or interest that the student may incur.

3. SCHEDULE OF FEES

Peak-Online "schedule of fees" is determined before the start of the academic year. The schedule of fees applicable at the time this contract is signed will remain in force for the period ending in the December month of that year. Fees will increase annually and the Management will endeavour to communicate the new schedule of fees 2 (two) calendar months in advance. The new fees will be implemented from the beginning of the academic programme in the following year.

4. PAYMENT OF FEES

Fees are payable in advance. No cash payments will be accepted. Payment of monthly fees are not subject to presentation of an invoice or statement and are due on or before the first (1st) of the month. If fees are not reflected in Peak’s business account by the 1st, on the 2nd of the month a friendly reminder will be sent via email. If fees are not paid by the 2nd, contact will be made telephonically. If fees are still not paid by the 5th of the month a letter of demand will be sent.

5. LATE PAYMENT PEANALTY FEES

Peak Academy will levy a penalty fee on the account for late payment according to the following charges where applicable:

  1. Email: R20 per email
  2. Phone call: R20 per phone call
  3. Peak Academy’s letter of demand: R50
  4. Handing over to Accountability Debt Management Services: R150
  5. Penalty interest of 15% accumulative on a monthly basis.
6. DEBT MANAGEMENT PROCEDURE

Peak Group is a member of Accountability Debt Management Services. If the account is in arrears by 30 days or more, it will be handed over to Accountability Group (Pty) Ltd, who will manage the debt collection process. This could result in the Payee and Parent, jointly and severally being blacklisted on the credit bureau which will negatively affect credit worthiness. Furthermore, the student will be immediately suspended from Peak-Online and will not be allowed to attend any program or function of Peak-Online until all outstanding fees, including but not limited to, interest and collection costs have been settled in full.

The non-payment fees that might be due to be paid to Peak-Online will result in the termination of contract and all outstanding payments to Peak Academy will become payable immediately. Non-payment of any fees will result in the registering of such non-payment with the relevant credit bureau.

7. METHOD OF PAYMENT

Peak-Online prefers the payment of any fees via debit order. The necessary debit order payment documentation is available from the administration office. Your motivation not to pay or refusal to pay accounts via debit order will be considered during the financial evaluation process prior admission of your child to Peak-Online.

8. TERMINATION AND NOTICE REQUIREMENTS

Should you wish to terminate your child’s enrolment at Peak-Online, a written notice of one (1) calendar month’s is required. Should you choose to remove your child from Peak-Online prior to the termination date, you accept and acknowledge that fees equal to a one (1) calendar month’s period will be charged to your account. You acknowledge that the administration, registration and/or enrolment fees are non-refundable.

9. CREDIT CHECK

You agree that Peak-Online will be allowed to perform a credit check on the parent and or person responsible for the payment of the account and it is understood that depending on the results, the enrolment of your child may be withdrawn at the sole discretion of the Peak-Online Management. The results will be kept confidential and Peak-Online will not furnish reasons for such a decision.

10. GENERAL

You choose the residential address set out herein before as your chosen legal address for the service of all notices and legal processes and the postal and email addresses for all other communications by Peak-Online to you. You confirm that all the particulars that you may furnish or that you have furnished to Peak-Online in, under or in terms of this contract or otherwise from time to time are or will be, to the best of your knowledge and belief, full, true and accurate. You undertake to advise Peak-Online in writing of any changes to the details included in this contract.

Declaration


Declaration: I/we, the undersigned, do hereby declare that I/we have read and understood this Contract, including all Policies.

I/We hereby undertake to:

  1. Comply with all the undertakings as set out in this Enrolment Contract
  2. Acknowledge that I am responsible for the payment of the relevant Tuition Fees and additional fees as set out by Peak-Online relative to the tuition and additional costs relative to the child enrolled.
  3. Give one calendar month’s written notice before withdrawing our child (named above) from Peak-Online or, alternatively paying one calendar month’s fees in lieu of notice.
  4. Advise Peak-Online of any changes in personal details as and when they may occur.
